Throwing the first punch is almost always wrong and can lead to legal trouble. But if the guy was touching Art and said "I'm going to f&C% you up," and Art legitimately thought that he was about to be attacked, then even if he punched first it's self defense. You don't have to be hit first to be allowed to defend yourself.

Now, proving that this is what happened, and that the threat of violence from this jackass was real, might be difficult. It depends on how the witnesses remember it happening.
